Terms and conditions
It is important that you read and understand these terms and conditions before proceeding with this transaction. If there is any term that you do not understand or do not wish to agree to, please discuss it withus. Only proceed with this transaction if you wish to be bound by the terms and conditions set out below.
This agreement applies as between you, the User of this Web Site and us, the owner(s) of this Web Site. Your agreement to comply with and be bound by these Terms and Conditions is deemed to occur upon your first use of the Web Site. If you do not agree to be bound by these Terms and Conditions, you should stop using the Web Site immediately.
No part of this Web Site is intended to constitute a contractual offer capable of acceptance. Your order constitutes a contractual offer and our acceptance of that offer is deemed to occur upon our sending a dispatch email to you indicating that your order has been fulfilled and is on its way to you.
These terms and conditions (the “Terms and Conditions”) apply to the sale of PyoRyx Art Limited Print or Portfolio (the “Artwork”) by the Artist (the “Artist”) by PyoRyx Art to you.
- Title and Risk
As soon as the purchase price is paid in full, you will become the legal owner of the Artwork and, upon such payment, you will be responsible for the Artwork and the risk of damage to or loss of the Artwork will pass to you.
- Ownership of the Artwork Copyright
3.1 It is the Artist’s expectation that the Artwork will not be purchased for resale and will be retained by you for your own personal enjoyment. Specifically, you may not sell or offer for sale the Artwork on any interne- based auction or other website.
3.2 Copyright in the Artwork remains the property of the Artist.
3.3 You may not produce any image of the Artwork and may not, at any time, publish or submit for publication or reproduction any image of the Artwork to any third party, including any internet website for any purpose.
3.4 If you breach any of your obligations under paragraph 3.3 you agree that:
(a) the payment of damages will not be a sufficient remedy to compensate us or the Artist for your breach;
(b) we may, and the Artist may, apply to the court for an order to prevent you from continuing to breach your obligations under these Terms and Conditions; and
(c) we may, and the Artist may, contact the operator of any internet website on which the Artwork is being offered for sale or on which an image of the Artwork has been placed by you or at your direction, and instruct such operator, on your behalf, to remove any such offer for sale or image from any such internet website.
- PURPOSE AND EFFECT
4.1 These terms and conditions set out all the terms of agreement other than price between you as buyer and us as seller, in relation to the sale and purchase of the item or items identified in the invoice, which we refer to below as “the Work”. We confirm that we either own the Work or are authorised to sell it on behalf of the owner.
4.2 If you wish to rely on any variation of, or addition to these terms and conditions, you must ensure that the variation or addition has been agreed by us in writing.
- STATEMENTS ABOUT THE WORK
5.1 All statements by us as to the authenticity, attribution, description, date, age, provenance, title or condition of the Work constitute our judgement and opinion only (save that this shall not operate so as to exclude any liability on our part for misrepresentation) and are not warranted by us. We do not accept any liability as a result of any changes in expert opinion which may take place subsequent to the sale.
5.2 While we will on request explain the condition of the Work at the time of the sale and provide any information in our possession about condition for which you may reasonably ask, we will not be responsible for any subsequent deterioration of the Work, however occasioned, after the sale.
5.3 You are responsible for satisfying yourself as to any statements made by us as to the matters set out in clauses 2.1 and 2.2 above.
- PAYMENT OF PURCHASE PRICE
You must pay us the full price for the Work, together with any agreed delivery or framing costs and any VAT payable to us by paypal, credit card, bank transfer or such other methods as we agree.
- PASSING OF OWNERSHIP
7.1 Full legal title to the Work will not pass to you until we have received in full in cleared funds all sums due in respect of the Work.
7.2 If you have possession of the Work before full payment has been made, you must:
7.2.1 keep possession of it, not sell it or hand it over to any other person or dispose of any interest in it;
7.2.2 in the case of a Work consisting of more than one item, keep those items together;
7.2.3 keep any identifying marks showing that we own the Work clearly displayed;
7.2.4 store the Work on your premises and at no cost to us, separately from other property;
7.2.5 at our request, and after we have given you reasonable notice, allow us or a third party acting on our behalf to have access to the Work in order to inspect it.
7.2.6 preserve the Work in the same state as it was on delivery and in particular, not restore, repair, clean or reframe it without our written consent.
If Goods are being ordered from outside the EU, import duties and taxes may be incurred once your Goods reach their destination. If you are buying internationally, you are advised to contact your local customs authorities for further details on costs and procedures. As the purchaser of the Goods, you will also be the importer of record and as such should ensure that your purchase is in full compliance with the laws of the country into which the Goods are being imported. Please be aware that Goods may be inspected on arrival at port for customs purposes and we cannot guarantee that the packaging of your Goods will be free of signs of tampering.
- Colour / image disclaimer
Due to the many variations in monitors and browsers, color samples may appear different on different monitors. Computer monitors are not all calibrated equally and color reproduction on the Internet is not precise. Since it is not possible to guarantee our online colors will look the same on all computers, we do not guarantee that what you see accurately portrays the color of the actual window treatment. We do our very best to make sure our samples are as close to the exact product as possible, but cannot guarantee that what you see is an exact sample.
By checking the box on the checkout screen you are agreeing that you have read, understand and agree to these terms. There are no returns due to color variances. May vary by product see product specifications for detailed information.
- RETURN POLICY
We want you to love our products as much as we do! All of our products are handmade, so the actual pieces may vary slightly in color and size from the images shown online and may also have slight imperfections. We love this about our products; they are all unique and have a handmade story behind them. We strive to provide the most accurate information about each product; please make sure that you have carefully read the descriptions and viewed the images of each item before placing an order.
If you are not completely satisfied with your order, please email our office at email@example.com within 10 days of receipt of your shipment. Please note that International orders are final.
To be eligible for a return, your item must be unused and in the same condition that you received it. Any item purchased at a discounted price is a FINAL SALE and is not eligible for return. Please note that we cannot refund the original shipping charges as these are paid directly to our carrier.
Include “RETURN” in the subject line of your email and a brief description of why you would like to return an item. Your return must be approved by our office. Do not return a product unless you have received an email approval from our office.
Your return order must be shipped and received at our office within two weeks of receiving your return approval from us. You will be responsible for paying for your own shipping costs for returning your item. We recommend that you choose a carrier that can provide tracking and proof of delivery as we are not responsible for items lost or damaged in transit and this will help ensure that your product is received at our office within the two week return window.
We reserve the right to refuse your return if your order is received after the two week time frame, the item is not in its original condition, or if it is damaged or altered in any way.
Once your return is received and inspected, we will send you an email to notify you that we have received your returned item. We will also notify you of the approval or rejection of your refund.
If you are approved, then your refund will be issued in the same form as the initial payment. We cannot refund the original shipping charges as these are paid directly to our carrier. You will be refunded for the amount you paid, minus the original shipping charges. Sometimes it can take up to 3 weeks to see the credit in your account, depending on the form of payment.
- EXCHANGE POLICY
Due to the handmade nature and limited quantities of our products, we cannot issue exchanges. If you would like to return an item, please refer to our Return Policy above.
- CANCELLATION POLICY
Orders can only be cancelled if the package has not yet been shipped, or a shipping label has not yet been issued. If we have already shipped your order and you would like to return the item, please refer to our Return Policy above.
If we receive your cancellation request before we have shipped your package, you will be notified via email that your order has been cancelled and you will receive a full refund. The refund will appear in your account approximately 5 to 10 business days after the order is cancelled.
